At Billet Racing® our goal has been , and
will continue to be , providing the very
best and most innovative products possible.
The products manufactured and/or sold by
Billet Racing® are designed and engineered
in-house by Billet Racing® to meet our exacting
standards. We trust you will be very impressed
with our products and/or services.
IMPORTANT NOTICE UPDATED March 1st, 2005 Your order may be rejected should you fail
to read and sign the terms and conditions
supplied with your order form. If you have
any trouble understanding these terms and
conditions please contact us. Remember you
will be asked to sign to acknowledge the
terms and conditions set out.
LIABILITY LIMITATIONS:
Except as may be expressly set forth in the
product invoice , Billet Racing® makes no
representations or warranties as to any of
its products , express or implied , including
without limitation any warranties of merchanability
or fitness for a particular purpose. Motor
Vehicles, Aircraft, Machinery can be dangerous.
Billet Racing® has no control over the usage
of any product. Billet Racing® expects the
customer to exercise good judgment as to
the proper selection , installation , use
and maintenance of any parts. Billet Racing®
assumes no responsibility for damage and/or
injury of any kind because of the misuse
or the improper application of any products
in any way by any person(s). Billet Racing®
shall not be liable for any indirect or consequential
damages whatsoever. While we have total confidence
in our products , we strongly suggest test
fitting all parts prior to any modifications
or painting etc. Billet Racing® will not
be held responsible for any materials and/or
labor cost under any circumstances.

BACKORDERS: Items temporarily out of stock will be shipped
automatically when available unless you request
NO BACKORDERS. Backorders from a prepaid
freight order are shipped with no additional
freight charges. Backorders over 30 days
are confirmed before shipping.
SHIPPING AND DEALING WITH SHIPPING DAMAGE: ALL products are closely inspected before
packaging and shipment . Product damage occurring
during transit is the sole responsibility
of the carrier, Billet Racing® accepts no
responsibility for shipping damage. ALL claims
must be reported immediately to the carrier.
Be sure to retain all packaging materials
and paperwork. We will gladly assist you
whenever necessary. We ship the most economical
way to you..via the standard postal service
normally and where the item(s) may be larger
than acceptable via the postal service we
will use UPS, FedEx or DHL. Should you wish
not to use one of these carriers, please
notify us prior to your item(s) being shipped
out. When your item(s) are packed and ready
to ship we will advise the total including
shipping costs –under no circumstances will
we ship to non account customers without
item(s) being paid for in FULL.
RETURNS: Merchandise may not be returned to Billet
Racing® unless it was purchased directly
from Billet Racing® . Requests to return
merchandise must meet the terms of our Limited
Warranty stated below and/or must have been
shipped in error by Billet Racing® . Proof
of purchase (INVOICE NUMBER , ETC.) is required.
Before shipping the merchandise , The item
should be re-packaged carefully to prevent
damage. The INVOICE NUMBER and the word ("RETURN")
shall be marked clearly on the outside of
the package. Any package sent without an
invoice and/or order number will not be accepted
and subsequently mail refused and returned
to sender. Should you have unfortunately
ordered the incorrect product and you do
not wish to exchange for the correct product
a 20% re-stocking fee applies with no exceptions!.
CUSTOM ORDERS, CONTRACT & NON ACCOUNTS:
All custom orders, under contract orders,
or non account customers with Billet Racing®
are required to fax, mail email us an order.
In the event the customer cannot supply an
official company order, the customer will
be faxed and/or mailed a work order requisition
form. All custom orders, under contract orders,
non account customers are subject to pay
50% deposit down payment- required to be
paid in full prior to work commencement.
Once your deposit is received we will mail,
fax, email or call you to advise your deposit
has been received. If you were supplied a
written quotation from Billet Racing® you
are required to supply those relevant engineers
drafts/drawings to manufacture from in form
of hardcopy, floppy disc or hard disk, or
if you supplied a sample component(s) you
will be required to supply those relevant
component(s), should you not supply those
relevant copies or component(s) that we may
have quoted from originally, we reserve the
right to refuse your order and forfeit your
50% deposit. While we make every effort for
your order to be processed smoothly through
our system we will not be held responsible
for any liability and/or damages claims as
the result of late/overdue delivery times
that we may have estimated to you originally.
Once your order is completed you will be
notified by mail, fax, email or call. When
you receive notification of completion we
will advise the total balance payable upon
delivery or pickup.
DEFAULT & CONSEQUENCES OF DEFAULT: If you do not pay a bill by the due date
for payment set out on it;
you may be charged a late payment charge
and/or interest on all unpaid amounts from
the due date until you pay it at the interest
rate set out by Billet Racing®
you may be required to pay any costs that
are incurred by anyone (including agents)
in recovering the money you owe, or in exercising
any other rights, including commissions,
credit collection and legal costs on a solicitor
and client basis
we may withhold, suspend, restrict or terminate
any Goods/Service we provide for you.
PRICE AND PAYMENT: At the Sellers sole discretion;
(a) The Price shall be as indicated on invoices
provided by the seller to the buyer in respect
of Goods supplied; or
(b) The price shall be the Seller’s current
price at the date of delivery of the Goods
according to the Sellers current Price list.
(c) The Price of the Goods shall be the Seller’s
quoted Price if a quote was requested by
the Buyer which shall be binding upon the
Seller provided that the Buyer shall accept
in writing the Seller’s quotation within
thirty (30) days.
(d) At the Sellers sole discretion a deposit
may be required. The deposit amount or percentage
of the Price will be stipulated at the time
of the order of the Goods / Services and
shall become immediately due and payable.
(e) Time for payment for the goods shall
be of the essence and will be stated on the
invoice, quotation or any other order forms.
If no time is stated then payment shall be
on the delivery of the Goods / Services.
(f) At the Sellers sole discretion payment
may be due at the date of this agreement.
(g) At the Sellers sole discretion, for certain
approved Buyers payment will be due at the
end of the month following the month within
which the invoice was dated.
(h) At the Sellers sole discretion, payment
for approved Buyers shall be made by instalments
in accordance with the Seller delivery/ payment
schedule.
(i) The seller may withhold delivery of the
Goods/Service until the Buyer has paid for
them, in which event payment shall be made
before the delivery date.
(j) Payment will be made by cash on delivery,
or by cheque, or by bank cheque, or by electronic
transfer, or by credit card, or by direct
debit, or by money order, or by PayPal, or
by international bank wire, or by any other
method as agreed to between the Buyer and
the Seller.
(k) The Price shall be increased by the amount
of any GST and other taxes and duties which
may be applicable, except to the extent that
such taxes are expressly included in any
quotation given by the Seller.
LIMITED WARRANTY: Billet Racing® warrants goods sold from original
date of invoice for a period of 30 DAYS against
defects in workmanship and materials . Billet
Racing® shall be liable only for the invoice
value of the item warranted and not for shipping
carrier costs whatsoever. Billet Racing®
is not responsible for the failure of any
product that results from normal wear &
tear , misuse , modification , or improper
installation . Billet Racing® finally reserves
the right to inspect all returns for conformance
to our stated warranty policy. Although we
use trusted Chrome platers, Anodizing finishers,
Galvanizers & Heat Treaters we will not
offer warranty for these finishes that may
be subject to mishandling upon installation,
accidentally damaged during transit, or defective
workmaship. While we are confident in our
workmanship Billet Racing ® will not be held
responsible for any materials and/or labor
cost under any circumstances should your
item fail to install correctly. We recommend
pre-fitting any custom or replacement components
to ensure correct fit. Please use extreme
caution when installing an anodized coated
or chrome plated item the finish is fragile!.
COMPLAINTS PROCEDURE: Should you have any concerns or complaints,
please address them in the first instance
to billetracing@optusnet.com.au You will receive an immediate acknowledgement
of receipt, and at least a preliminary response
within Two (2) working days. Our preliminary
response will, at the very least, provide
a detailed plan and timescale for dealing
with the matter you have raised. In most
cases we anticipate resolving any issue within
Two (2) days of receipt of your communication.
All concerns and complaints will be treated
personally, confidentially and seriously.
Your satisfaction with the service you have
received from Billet Racing® is of paramount
importance to us, and we welcome your comments.
1. DEFINITIONS: 1.1 “Seller” shall mean Billet Racing® and
any of its entities.
1.2 “Buyer” shall mean the buyer or any person(s)
or Seller acting on behalf of and with the
authority of the buyer.
1.3 “Guarantor” means that person(s), or
entity who agrees herein to be liable for
the debts of the Buyer if a Limited Liability
Buyer on a principal debtor basis.
1.4 “Goods” shall mean Goods supplied by
the Seller to the Buyer (and where the context
so permits shall include any supply of services
as hereinafter defined).
1.5 “Services” shall mean all services supplied
by the Seller to the Buyer and includes any
advice or recommendations (and where the
context so permits shall include the supply
of Goods as defined supra).
1.6 “Price” shall mean the cost of the Goods
as agreed between the Seller and the Buyer
subject to clause 4 of this contract.
